1 DEFINITIONS

this agreement and any special terms and conditions agreed in writing by the Supplier;
2 CONDITIONS
2.1 Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.
2.2 These Terms and Conditions shall apply to all contracts for the provision of Services by the Company
to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.3 Any variation to these Terms and Conditions (including any special terms and conditions agreed between
the parties) shall be inapplicable unless agreed in writing by the Supplier.

2.5 Any special conditions applying to the provision of the Services are set out in the Schedule to this agreement.
3 ORDERING
3.1 All orders for Services shall be deemed to be an offer by the Buyer to purchase Services pursuant
to these Terms and Conditions and are subject to acceptance by the Supplier. The Supplier may choose not to
accept an order for any reason.
3.2 When making an order through the Website, the technical steps the Buyer needs to take
to complete the order process are described in the order process selection pages of the website.
4 PRICE AND PAYMENT
4.0 The payment processors for the website are stripe.com and skrill.com
You do not have to have a Skrill or Stripe account to purchase from the website, guest payments can be made through the Payment portal using credit/debit cards or
Offline payments via BACS or Bank Transfer can be arranged if the buyer so wishes by contacting us at Contact Us form
4.1a All prices for physical goods presently only cover postage and delivery to United Kingdom mainland destinations. For UK islands, Eourope and the rest of the world
please contact us on our contact us page.
4.1b The price of all Services/Goods will be stated on our Website. All prices are inclusive of
postage and packaging and inclusive of VAT unless otherwise stated. Import tax and other taxes and duty must be allowed for when
the buyer is resident outside of the United Kingdom respective to the laws of that country.
4.2 The total purchase price will be displayed before the Buyer confirms the order.
4.3 After the order is received the Supplier shall confirm the purchase by email in the form of a
receipt from the online payment processor and further comfirmation reciept email from westcornwallroofing.com
This will include both the descriptions of the service/goods purchased plus the price.
4.4 Discounts and Special Offers are down to the discretion of the company.
4.5 If any payment is not paid or the authorising bank rejects payment method, payment will
have to be completed before any goods are sent out or any service undertaken.
5 RIGHTS OF SUPPLIER
5.1 The Supplier reserves the right to periodically update prices on the Website, which cannot
be guaranteed for any period of time. The Supplier shall make every effort to ensure prices are correct at the point at
which the Buyer places an order.
5.2 The Supplier reserves the right to withdraw the Services from the Website at any time.
5.3 The Supplier shall not be liable to anyone for withdrawing the Services from the
Website or for refusing to process an order.
6 CANCELLATION
Where the Buyer is a Consumer, the Buyer has the right to cancel the Contract, by notice in writing to

at any time before seven working days has passed
from the day after the Contract was made (Our working days are Monday to Friday 9am – 5pm GMT. Saturday and Sunday
are not recognised as working days). If, however, the Supplier starts to perform its side of the Contract
with the agreement of the Buyer before the Buyer exercises this right to cancel, the right to cancel is lost.
7 REFUND/RETURNS POLICY
Please take careful note of our returns policy. We reserve the right to refuse any returns if this procedure is not followed.
If you have a product / service to which you require a refund, please contact us via email on

Include your details and that of purchase in addition to providing a reason for refund..
This must be done within 7 working days of receiving your order.
7.1 You may return goods (except those contained in 7.7) and receive a refund, if you do
so within 7 working days from the date of delivery. Goods must be returned as set out in their original unused condition and
with all packaging intact, as set out in 7.7.
7.2 If the goods delivered are faulty or have been damaged in transit, then we will either
exchange the goods free of charge, or give you a full refund including delivery costs, providing the goods are returned to us
within 7 working days from the date of delivery.
7.3 We will not accept returns for any non-faulty items after 7 working days have elapsed or
for items that have been used. In all circumstances you must contact us as set out in 7.1.
7.4 If the item ordered is not to taste and an exchange is required, this can be provided but
a delivermcry charge at our standard rate will be incurred. If you wish to exchange the item for an alternative one, please contact
us from the Contact Us Page to ensure that the item you require is available.
7.5 Bespoke products such as works of art, CD’s in training/resources requested by you are not returnable under this agreement unless defective.
For your protection we strongly recommend that you use a recorded delivery service to return goods..
Proof of posting is not proof of receipt and all goods remain the responsibility of the customer until we receive them.
7.6 All goods must be in their original condition and with all packaging intact, as we
cannot exchange used goods. Due to the delicate nature of art prints, canvas panels must be wrapped individually, as provided, to
prevent scratching.
7.7 Following receipt of returned goods as set out above, refunds will be processed within 14 days.
Refunds will be credited via Company Cheque payment method.
These Terms do not affect your statutory rights. If you have any further questions please contact us.
8 LIMITATION OF LIABILITY
8.1 Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any
breach of these Terms and Conditions by the Supplier the remedies of the Buyer shall be limited to damages
which shall in no circumstances exceed the price of the Services and the Supplier shall under no
circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
8.2 Nothing in these Terms and Conditions shall exclude or limit the liability of the Supplier for
death or personal injury resulting from the negligence of the Supplier or that of the Supplier’s agents or employees.
9 WAIVER
No waiver by the Supplier (whether express or implied) in enforcing any of its rights under this
agreement shall prejudice its rights to do so in the future.
10 FORCE MAJEURE
The Supplier shall not be liable for any delay or failure to perform any of its obligations if the
delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God,
strikes, lock outs, accidents, war, fire or failure of any communications, telecommunications or
computer system, and the Supplier shall be entitled to a reasonable extension of its obligations.
11 SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for
any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions
hereof shall continue in full force and effect as if these Terms and Conditions had been agreed
with the invalid illegal or unenforceable provision eliminated.
12 CHANGES TO TERMS AND CONDITIONS
13.1 The Supplier shall be entitled to alter these Terms and Conditions at any time but this right
shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
13.2 Any renewal of the Services will be subject to the Supplier’s then current Terms and Conditions.
13 GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the law of England
and the parties hereby submit to the exclusive jurisdiction of the English courts.
